Vector Responsibility based on Italian regulations
If there are no different agreements between the parts, in case of:
a) DOMESTIC TRANSPORT
Damaged or lost goods are treated in article 10
of the legislative decree number 286 dated November 21st 2005,
published on G.U. Nr. 6 dated January 9th 2006.
The above mentioned decree states that the vector responsible for
damaging or losing goods can reimbourse up to 1.00 Euro per kg.
b) INTERNATIONAL TRANSPORT
Damaged or lost good transportation
is regulated by C.M.R. (Convention relative au contrat de transport
international de Merchandises par Route) dated 19.05.1956 and accepted
in Italy with Law 621 of 06.12.1960.
C.M.R. is internationally recongnized and regulates: the transportation
contract , its execution and the vector’s responsibility.
In this case the compensation for total or partial loss is calculated
on the value of goods where and when the vector received it.
The maximum vector responsibility is 8,33 units per kg (unit = D.S.P.
i.e. special drawing rights with an equivalent value in Euros daily
published on "Il Sole 24 ore"), equal to 10.05 Euros in March 2006.
Vectore responsibility does not include all damages due to insufficient packaging.
